Section 1: Definitions

All Around Music LLC is a limited liability company with its principal place of business located at 6580 Monona Drive #1086 Monona WI US 53716. In this Privacy Policy, All Around Music LLC may also be referred to as All Around Music, we, us, or our.

Information is any data, personal or otherwise, that is: a. transferred from you to All Around Music, regardless of its country of origin, and b. recorded in any form.

Personal Information pertains to a specific individual, whether the individual is you or not, and can be linked to that individual. Sensitive Personal Information means Personal Information that reveals race, ethnic origin, sexual orientation, political opinions, religious or philosophical beliefs, trade union membership, or concerns an individual’s health. The Website includes all pages and content found or accessed under the All Around Music domain name www.allaroundmusic.us.

The Web Portal includes all password protected areas of www.allaroundmusic.us and all content downloaded, viewed, or accessed there.

Software includes all programs, routines, and symbolic languages downloaded or accessed through the Website or Web Portal or otherwise provided by All Around Music that control any functionality or direct any operations on a computer or other device. Collectively, the Website, Web Portal, Software, and any related email or SMS communication tools are referred to as the Services.

User means anyone accessing or using the Services provided by All Around Music, whether they are registered Users, guests, or internet Users, even if they did not directly access the Service used. It also includes persons using the Service even if they are accessing the Service through another person’s account. Instructor means a teacher who delivers lessons through the Services on behalf of All Around Music.

Section 2: What Information All Around Music Collects and Why

Any time a User accesses the Website or Web Portal, they receive a cookie from us. We use cookies, which are small pieces of data stored for an extended period on a computer, mobile phone, or other device, to make the Services easier to use and to protect both you and All Around Music. These cookies give All Around Music Information about your use of the Services. You can remove or block cookies using the settings in your browser, but in some cases that may impact your ability to use the Services. As part of registering as a User, All Around Music requires you to input your name, a valid email address, and either a password or a Google account used to sign in. You may also provide a mobile number, a mailing address, a time zone, the names of the children you book lessons for, and a parent or guardian name and email address. All Around Music stores and compiles this data and may retain it from Users who have terminated their accounts for legal compliance purposes or to maintain the ongoing confidentiality, integrity, availability, and resilience of All Around Music systems, Website, and Service.

If you sign in with Google, Google provides All Around Music with your name and verified email address. If you add a passkey to your account, All Around Music stores only the public key and a name for the passkey. The private key, and any fingerprint or face data used to unlock it, stay on your device or in your password manager and are never sent to All Around Music.

Messages and attachments that you send through the messaging features of the Services, including the support chat on the Website and conversations with Instructors, other Users, and All Around Music, are stored by All Around Music so they can be delivered and so that All Around Music can respond to support requests and keep the Services safe. To protect students, All Around Music staff can review messages between a student and an Instructor, including group conversations that an Instructor is part of, for security and safety purposes. Staff cannot view conversations that are only between students. Support chats with All Around Music are read by staff in order to reply to you.

To protect your account, All Around Music keeps security logs of sign ins, passkey changes, and similar actions, including the IP address and browser used. Instructors who connect Google Calendar to their account also authorize All Around Music to store the access tokens needed to create calendar events on their behalf. To report teaching hours, All Around Music also records when each person joins and leaves an AAM Studio lesson room.

When you choose to receive communications from All Around Music, we may also collect: a. your name and contact details, including email address and telephone or mobile number b. your communication preferences, including whether you wish to receive SMS text messages c. any information you provide when you respond to surveys, promotions, or giveaways or when you participate in events or sweepstakes.

When you access the Services from a computer, mobile phone, or other device, we may collect Information from that device about your browser type, location, and IP address, as well as the pages you visit.

Live Support Presence

So that All Around Music can offer timely help, the support chat on the Website reports which page of the Website you are currently viewing and an approximate location, limited to country, state or region, and city, derived by our hosting network from your connection. Your IP address is not stored for this purpose, and the location is approximate and may be unavailable. All Around Music staff can see, for a short window while you are on the Website, that a visitor is present, the page they are on, and this approximate location, and can open a chat with you to assist. Signed in Users are shown by the name on their account; visitors who are not signed in are shown as anonymous guests identified only by a random token stored in your browser, which you can remove at any time by clearing your browser site data. This Information is used only to provide support and understand how the Website is being used; it is never sold or shared with third parties.

This Information may be collected through server logs and through analytics tools such as Google Analytics and Facebook Pixel and other similar tools. As part of the Service, All Around Music also records teaching lessons delivered in AAM Studio, including the video and audio of both Instructors and Users and anything shared on screen, from the moment an Instructor and a User are both in the lesson room. The recording is made in the Instructor's browser and stored by All Around Music with its cloud storage provider (Cloudflare) for 10 days after the lesson. Where a recording is available, it is made available in your account so the lesson can be reviewed for practice. Recordings are also used to ensure quality and legal compliance. Recordings are not shared with third parties other than the participants in the lesson and the service providers that store them unless required by law.

If you pay for Services online, your payment card or bank account information is processed by a third party payment processor such as Stripe or PayPal, or, for ESA Participants, by the education savings account program or funding platform designated by their state. All Around Music receives limited payment related Information such as transaction date, amount, and a confirmation that payment has been completed, and for Monthly Plans a customer reference that allows you to pause or cancel your plan from your account. Use and storage of your full financial information is governed by the privacy policy of the applicable payment processor.

All Around Music also keeps a record of your lesson credits, bookings, cancellations, recurring lesson schedules, and invoices so that the Services can be provided and so that you can review your lesson history in your account.

Section 3: What Information All Around Music Does Not Collect

All Around Music does not intentionally collect Sensitive Personal Information. While All Around Music does not request this Information, we recognize that you may store some Information of this kind in your account or in communications sent through the Services. If you choose to keep Sensitive Personal Information in your account or private storage, you are responsible for complying with any regulatory controls regarding that data.

Section 4: How All Around Music Uses Collected Information

All Around Music uses Information provided to operate the Service and to contact you regarding changes, updates, account Services, customer Service, or any other reason associated with the Service or your use of the Service. All Around Music may contact you with Service related announcements from time to time. These include necessary Software updates and Web Portal or Website outages, among other things. All Around Music requires an email address to become a User so that All Around Music can make these communications. You may opt out of all communications except essential updates that relate to safety, security, or the proper functioning of the Service. Lesson reminder emails can be adjusted or turned off in your account settings.

All Around Music shares limited Information with the third party services used to deliver the Services and only for that purpose: Cloudflare to relay lesson video when a direct connection is not possible and to store lesson recordings, Google to sign you in and, for Instructors, to place lessons on their calendar, Stripe, PayPal, and, for ESA Participants, their state education savings funding platform to process payments, and email delivery providers to send Service emails. Instructors see the name, email address, time zone, child names, and lesson details of the students they teach so they can deliver lessons and communicate with you.

All Around Music does not send advertising or sales emails and does not upsell. Beyond the Service emails described above, All Around Music may occasionally email account holders about updates to the Website, new features, lesson scheduling, and events that All Around Music is holding. These update emails are part of the Service. If you would prefer not to receive them, contact All Around Music at contact@allaroundmusic.us; essential notices about your account and lessons will continue. All Around Music may use Information to monitor and analyze trends, usage, and activities in connection with the Services and to improve the Services.

All Around Music may use Information to detect, investigate, and prevent fraudulent transactions and other illegal activities and to protect the rights and property of All Around Music, its instructors, and its Users. All Around Music may also use your Information to fulfill its obligations under applicable law, to carry out any contract between you and All Around Music, or to carry out any other purpose described to you at the time your Information was collected, provided such use is consistent with this Privacy Policy.

Use of Information for SMS Text Messages

If you provide your mobile number and consent to receive SMS text messages, All Around Music may use your Information to send: a. account and Service messages such as booking confirmations, reminders, schedule changes, and important notices about your account or lessons b. customer support messages responding to your questions or requests c. where you have given separate consent, update messages about new features or events that All Around Music is holding. Message frequency will vary based on your interactions with All Around Music. Message and data rates from your mobile carrier may apply.

Your consent to receive SMS marketing messages is voluntary and is not a condition of purchasing any Services from All Around Music. You may opt out of marketing SMS messages at any time as described in Section 5 and Section 9 of this Privacy Policy. All Around Music may use vendors and service providers to deliver SMS text messages on its behalf. These providers are permitted to use your Information only to support All Around Music in sending and managing those messages.

Section 5: How You Can Access and Control the Information All Around Music Collects

Do Not Sell My Personal Information

All Around Music does not sell, rent, trade, or otherwise share your Personal Information with anyone for money or for any other valuable consideration, and has never done so. This includes the Personal Information of children. Security and privacy come first in how All Around Music builds and runs the Services, and the only third parties that receive your Information are the service providers named in this Privacy Policy that All Around Music needs in order to deliver lessons, process payments, and send Service communications. Because All Around Music does not sell Personal Information, there is nothing to opt out of. If you have any question about how your Information is used, contact contact@allaroundmusic.us.

All Around Music adheres to the General Data Protection Regulation and the California Consumer Privacy Act with respect to all Personal Information. The following are the provisions of the GDPR and CCPA with regard to this Policy.

Notice

All Around Music shall inform you of the purposes for which it collects and uses Personal Information and the types of nonagent third parties to which All Around Music discloses or may disclose that Information. This includes any third party service providers that support email or SMS text message communications.

All Around Music shall provide you with the choice and means for limiting the use and disclosure of your Personal Information. Notice will be provided in clear and conspicuous language when you are first asked to provide Personal Information to All Around Music or as soon as practicable thereafter. In any event, you will receive notice before All Around Music uses or discloses the Information for a purpose other than that for which it was originally collected.

Choice

All Around Music will offer you the opportunity to choose, by way of an opt out, whether Personal Information is to be disclosed to a third party or to be used for a purpose other than that for which it was originally collected or has subsequently been authorized. All Around Music does not send marketing email. For occasional update emails about Website features and events, you may opt out at any time by contacting All Around Music at contact@allaroundmusic.us.

For SMS text messages, you may opt out of marketing messages at any time by replying STOP to any message you receive from All Around Music. After you send the SMS message STOP, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive marketing SMS messages from us. If you want to receive SMS messages again, you can reply START or contact us at contact@allaroundmusic.us to reenroll.

You may also manage your communication preferences, including whether you wish to receive update emails or SMS text messages, by contacting All Around Music at contact@allaroundmusic.us. Please note that even if you opt out of update emails or marketing SMS messages, All Around Music may still send you non marketing messages that are necessary to provide the Services, such as booking confirmations, lesson reminders, or important notices about your account.

Onward Transfers

Prior to disclosing Personal Information to a third party, All Around Music will notify you of the disclosure and allow you the choice to opt out, except where such disclosure is required by law. All Around Music will ensure that any third party to which Personal Information may be disclosed is subject to law providing the same level of privacy protection or agrees in writing to provide an adequate level of privacy protection, including with respect to email and SMS communication services.

Data Security

All Around Music shall take reasonable steps to protect the Information from loss, misuse, unauthorized access, disclosure, alteration, or destruction. All Around Music has in place appropriate physical, electronic, and managerial procedures to safeguard and secure the Information. All Around Music cannot guarantee the security of Information on or transmitted via the Internet or through SMS networks.

Data Integrity

All Around Music shall only process Personal Information in a way that is compatible with and relevant to the purpose for which it was collected or has been authorized. To the extent necessary for those purposes, All Around Music shall take reasonable steps to ensure that Personal Information is accurate, complete, current, and reliable for its intended use.

Access

You can view and update your name, contact details, mailing address, time zone, child profiles, lesson reminder preferences, and passkeys at any time from the profile and settings pages of your account. All Around Music will allow you access to your Personal Information and allow you to correct, amend, or delete inaccurate Information. For access requests, please contact contact@allaroundmusic.us. Access will not be allowed where the burden or expense of providing access would be disproportionate to the risks to your privacy or where personal rights other than your own would be violated. Access will only be granted a maximum of two times during any twelve month period. While accessing your Information, you will be allowed to export a copy of your Information.

Retention

All Around Music will keep your Personal Information only for as long as necessary to fulfill the purposes described in this Privacy Policy, including for the purpose of satisfying any legal, accounting, or reporting requirements and for the establishment, exercise, or defense of legal claims. When we decide how long to keep Information, we consider the amount, nature, and sensitivity of the data, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it, and whether we can achieve those purposes through other means.

Enforcement

All Around Music uses a self assessment approach to assure compliance with this Policy and at least annually verifies that the Policy is accurate, comprehensive, prominently displayed, completely implemented, and accessible to remain in conformity with the GDPR and the CCPA.

Dispute Resolution

All Around Music encourages you to raise any concerns using the contact Information we have provided. We will investigate and attempt to resolve any complaints and disputes regarding the use and disclosure of Personal Information in accordance with the GDPR and the CCPA. If a complaint or dispute cannot be resolved through our internal process, we agree to dispute resolution using the small claims courts of Wisconsin as a third party resolution provider.

Section 6: How All Around Music Treats Information from Children Under 13 Years Old

All Around Music is a Website that provides online music lessons using video conference technology. We welcome students of all ages and as such are compliant with the Children’s Online Privacy Protection Act of 1998. We therefore take special precautions when collecting personal information from children under the age of 13.

Children’s privacy law requires that we inform parents and legal guardians about how All Around Music collects, uses, and discloses personal information from children under the age of 13 years. Furthermore, this law requires that we gain consent from parents and or legal guardians in order for children under the age of 13 years to use certain features of our Website.

What information is collected from children

We do not collect personal information from children unless they register on the All Around Music Website. The only personal information that is collected during the registration process is the parent email address, the student and parent name, booking information, and any recordings made by All Around Music in providing the Service.

Recordings of a child lesson are stored by All Around Music with its cloud storage provider (Cloudflare) for 10 days after the lesson, and made available only in the parent or guardian account, so the lesson can be reviewed for practice, and to All Around Music for ensuring quality and legal compliance. Recordings will never be shared with other third parties unless required by law. These recordings will be considered confidential and will be treated as such by All Around Music.

Accounts must be created by a parent or guardian, who then adds a profile for each child they book lessons for. All Around Music communicates with the parent or guardian regarding the account. Child profiles hold only the child name; lesson bookings, recordings, and messages are attached to the parent or guardian account.

All Around Music does not share user information with third parties unless stated otherwise in this Privacy Policy or under special circumstances described in Section 8.

How is the information collected used

All Around Music uses the information collected during the registration process to communicate with users and provide Services. The information collected is never sold to unaffiliated third parties.

By using All Around Music Services, you may be granting access to personal information to third parties including Google. Lessons take place in AAM Studio, All Around Music's own video lesson rooms. Live video and sound travel directly between the browsers in the lesson, or through a relay run by Cloudflare when a network does not allow a direct connection, and lesson recordings are stored with Cloudflare. By purchasing and allowing your child to participate in online lessons, you are consenting to potential third party information exchange.

How do we notify and obtain consent from parents regarding their children information

If your child under the age of 18 years attempts to register with the All Around Music Website, he or she will be prompted to provide parent or guardian contact information. By purchasing classes for your child under the age of 18, parents and guardians are consenting to the collection of their child information.

What access and rights do parents have

Parents and guardians have the right to review the information that has been collected from their child. Parents and guardians additionally have the right to withdraw consent for the use or collection of personal information from their child and may request that their child information be deleted from the All Around Music system.

Section 7: How All Around Music Secures Your Information

Data All Around Music receives from you is stored in All Around Music secure cloud hosted database or, for lesson recordings, in All Around Music cloud storage (Cloudflare), and may also be stored with secure third party payment, email, and SMS service providers as necessary to provide the Services. Passwords are stored only as salted hashes. Passkeys and Google sign in let you access your account without All Around Music ever receiving a password. All Around Music uses technical, administrative, and physical safeguards that are designed to improve the confidentiality, integrity, and accessibility of your Personal Information. These safeguards may include encryption, access controls, regular security reviews, and staff training.

Despite these efforts, no method of transmission over the Internet, email, SMS, or method of electronic storage is completely secure. For this reason All Around Music cannot guarantee absolute security of your Information. If we become aware of a data incident that affects your Personal Information, we will notify you and any applicable regulator where we are legally required to do so.

Section 8: How All Around Music Responds to Compelled Disclosure

All Around Music will not sell or otherwise transfer your private Information except where essential for providing the Services. However, All Around Music will give out Personal Information to comply with applicable law or a court order, to respond to lawful requests by public authorities, to prevent harm or injury, or to prevent fraud or other illegal activity. All Around Music may be required to share Information with government entities from a foreign country. You cannot opt out of this provision or otherwise require All Around Music to hold Information confidential in such a way as to cause All Around Music to violate any law.

Section 9: How All Around Music Will Communicate With You

All Around Music will contact you using the contact details that you provide, including your email address and, where you have consented, your mobile telephone number, and through messages within the Services, including the chat on the Website and in your account. We will only contact you for reasons that you have consented to or that are necessary in order to provide the Services.

Email Communications

All Around Music may contact you by email for: a. account administration and security, including registration, email verification, password assistance, sign in links, passkey changes, billing notices, and important Service updates b. lesson related communications, including booking confirmations, reminders, schedule changes, cancellations, and low credit warnings c. customer Service responses when you reach out for support d. occasional updates about the Website, new features, lesson scheduling, and events that All Around Music is holding. All Around Music does not send advertising or sales emails.

You may opt out of update emails at any time by contacting contact@allaroundmusic.us. You cannot opt out of essential Service communications that are necessary to provide the Services or to comply with legal obligations.

SMS Text Message Communications

If you provide your mobile number and expressly agree to receive SMS text messages, All Around Music may contact you by SMS for: a. transactional and Service messages related to your account, lesson bookings, reminders, schedule updates, and Service alerts b. customer Service messages in response to questions you send by text, when this channel is available c. update messages about new features or events that All Around Music is holding, where you have provided the required consent.

Message frequency will vary based on your interactions with All Around Music. Message and data rates may apply from your mobile carrier.

You can opt out of marketing SMS messages at any time by replying STOP to any SMS message from All Around Music. After you send the SMS message STOP, we will send a confirmation SMS message and you will no longer receive marketing SMS messages from us. For additional help regarding SMS, you may reply HELP or contact us at contact@allaroundmusic.us. Providing your mobile number and agreeing to receive SMS text messages is optional and is not required in order to purchase or receive Services from All Around Music.

All Around Music may use third party vendors to deliver and manage SMS text messages. These vendors are permitted to use your Information only to support All Around Music in sending and managing those messages.

Section 10: Updates to All Around Music Privacy Policy

All Around Music may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or for other operational reasons. When we make material changes, we will notify you before any updates take effect by sending an email to the email address associated with your account at least thirty days in advance. The email will include the new Privacy Policy and instructions on how to accept the new Privacy Policy. We may also post a notice on our Website.

Your continued use of the Services after the effective date of any updated Privacy Policy will constitute your acknowledgment of the changes and your agreement to be bound by the updated terms, except where your express consent is required by law.
